Alabama will be allowed to put an inmate to death with nitrogen gas later this month, a federal judge ruled Wednesday, clearing the way for what would be the nation s first execution under a new method the inmate s lawyers criticize as cruel and experimental.U.S. District Judge R. Austin Huffaker rejected Alabama inmate Kenneth Eugene Smith s request for an injunction to stop his scheduled Jan. 25 execution by nitrogen hypoxia. Smith s attorneys have said the state is trying to make him the test subject for an untried execution method, and are expected to appeal the decision.The question of whether the execution by nitrogen gas can ultimately proceed could end up before the stanley cup U.S. Supreme Court. The state s plans call for placing a respirator-type face mask over Smith s nose and mouth to replace breathable air with nitrogen, causing him to die from lack of oxygen. Three states - Alabama, Mississippi and Oklahoma - have authorized nitrogen hypoxia as an execution method, but no state has attempted to use it so far.Smith, now 58, was one of two men convicted of the mur stanley cup der-for-hire slaying of a preacher s wife in 1988 that rocked a small north Alabama community. COLUMBUS, Ohio -- Police in Ohio responding to a reportof an armed robbery shot and killed a 13-year-old boy who they said pulled agun stanley cup from his waistband that waslater determined to be a BB gun.It happened Wednesday night in Columbus.Police said off yeezy icers were responding to a report of anarmed robbery involving multiple suspects. When they arrived on the scene, theysaid, the victim told them a group of people had approached him and demandedmoney. The victim said one of them had a gun. Police said the officers saw three males matching thedescripti nike dunk ons of the suspects and tried to speak with them, when two fled onfoot.Officers followed the males to the alley ... andattempted to take them into custody when one suspect pulled a gun from his waistband, police said in astatement early Thursday. One officer shot and struck the suspectmultiple times. The suspect, later identified as 13-year-old Tyree King,was taken to a childrenrsquo hospital, where he died.The male with King was identified, interviewed andreleased pending further investigation.The officers and the other suspect werenrsquo;t injured.Police also spoke with witnesses to both the robbery andshooting, and were searching for the third suspect in the robbery, reports CBS Columbus affiliate WBNS-TV.
