Washington mdash; The Supreme Court on Tuesday weighed the constitutionality of the Consumer Financial Protection Bureau s funding structure in what is the most significant test of the agency s 13-year existence, with several of the justices expressing skepticism toward arguments that the mechanism is outside the bounds of the Constitution. The question in the case is whether the way in which the CFPB receives its funding violates the Appropriations Clause of the Constitution. A federal appeals court found it does, but some of the justices indicated they were struggling to grasp the argument put forth by Noel Francisco, who argued on behalf of two trade associations that brought the case. The groups say Congress must approve annual appropriations for the CFPB. We re all struggling to figure out what s the standard that you would use, Justice Amy Coney Barrett said. Justice Sonia Sotomayor said she was at a total loss, noting that more than 60% of appropriations from Congress are standing appropriat stanley cup ions, meaning they don t require annual renewal. There s nothing in the Appropriations Cla stanley cup use itself or in the word appropriations that imposes the limits that stanley cup you re talking about, Barrett told Francisco. CLEVELAND -- A white Cleveland police officer had no choice but to fatally shoot a 12-year-old black boy carrying a pellet gun, an expert on police use of force said in jordan a report released publicly Thursday by the Cuyahoga County Prosecutor s Office.Tamir Rice was shot outside the Cudell Recreation Center in Cleveland Nov. 22, 2014. He died at a hospital the following day. Investigation of Tamir Rice shooting made public 02:29 Retired Florida police officer W. Ken Katsaris is the third expert who has concluded that patrolman Timothy Loehmann was justified in shooting Tamir. Last month, a retired FBI agent and a De stanley cup nver prosecutor both found the rookie patrolman exercised a reasonable use of force because he had reason to perceive the boy -- described in an emergency call as a man waving and pointing a gun -- as a serious threat. The release of the latest report comes at a time when a county grand jury is hearing evidence from prosecutors to determine whether criminal charges should be filed against L stanley cup oehmann and his training officer, patrolman Frank Garmback. This unquestionably was a tragic loss of life, Katsaris wrote. But to compound the tragedy by labeling the officers conduct as anything but objectively reasonable would also be a tragedy.
